Review of Legal Frameworks and Recommendations for the Energy Transition: Brazil, Chile, Colombia & Mexico

This report presents a review of the current state of regulations and public policies for the energy transition in Brazil, Chile, Colombia and Mexico. The report focuses on regulatory and public policy advancements in several key areas: the existence of a mandate for a just energy transition, specific rights established in existing legislation, respect for the rights of Indigenous peoples, regulations to advance gender equality, human rights due diligence obligations of non-state actors and the requirement to conduct impact assessments. Subsequently, in an annex, the report evaluates to what extent the legal frameworks and public policies on energy transition presented in the first part meet human rights standards and promote a just transition. This examination involved a comparative analysis to identify patterns, trends and gaps in the implementation of energy transition policies. Following this, based on the identified gaps, general recommendations for the Latin American region and specific recommendations for each country were developed, taking into account the particularities of their legal frameworks and public policies.

This report was based on four more in-depth and detailed reports by country. The research for these four reports was conducted by surveying existing legislation, public policies and various reports on the analysed issues. The thorough analysis of these sources allowed for an assessment of each country’s alignment with the criteria for a just energy transition. As a result of this research, significant advancements, gaps and major challenges were identified, which will need to be addressed in domestic regulation to further a just energy transition.
