Strengthening Public Services: Submissions to CESCR for Kenya's 6th Review
In collaboration with partners, we submitted two reports to the UN Committee on Economic, Social, and Cultural Rights (CESCR) for consideration during Kenya's 6th periodic review.
First Submission: Addressing Private Actors in Kenya's Education Sector
Developed in partnership with the International Commission of Jurist (ICJ), this submission builds on insights from our co-published July 2024 report, 'Build Us More Schools!' The Quest for Quality Free Education in Mabatini and Ngei Wards of Mathare, Nairobi. The report examines the involvement of private actors in Kenya's education sector while underscoring the urgent need for the government to provide more public schools and guarantee access to quality education for all children in Kenya.
The joint submission focuses on actionable recommendations to the legislative and executive branches, including:
- The construction of public schools,
- The conversion of selected APBET schools to public schools,
- The allocation of qualified teachers, and
- The monitoring and regulation of APBET schools.

Second Submission: Financing Public Services in Kenya
Prepared in collaboration with CEPCJ, EACHRights, and Hakijamii, this submission addresses the critical underfunding of public services such as education and health. It draws the Commission's attention to the need for Kenya to allocate the maximum available resources to finance public services, which are vital for the realisation of economic, social, and cultural rights.
The submission calls on the Committee to recommend to Kenya:
- To address the structural drivers of inequality, including regressive tax measures that disproportionately affect disadvantaged groups.
- To enhance transparency and accountability in public service delivery to prevent resource mismanagement and ensure equity in budget allocation.
